Bibhav Kumar, an advisor to Delhi Chief Minister Arvind Kejriwal, has been transported to Mumbai to retrieve data from his formatted iPhone. Kumar was arrested on Tuesday after allegedly attacking AAP MP Swati Maliwal, police said. Kumar is currently in five-day judicial detention in connection with the Swati Maliwal assault case which happened at the Chief Minister's Delhi house.
Police said Kumar formatted his phone before sending the data to someone or a device in Mumbai. His phone was taken after his arrest, but it was discovered to have been wiped clean, reported agencies.
The report added that the authorities stated that in Swati Maliwal assault case the sequence of crime recreation is critical in determining whether the claimed formatting was used to remove critical evidence from Kumar's phone. Based on their findings, the Delhi Police would either seek more time in remand or activate Section 201 in the case, police sources told ANI. Section 201 of the Indian Penal Code (IPC) punishes individuals for destroying evidence of a crime.
Meanwhile, a Special Investigation Team (SIT) has been formed to investigate the Swati Maliwal case. The SIT is headed by North Delhi's Additional Deputy Commissioner Of Police (DCP) Anjitha Chepyala who has been handling the investigation. Three Inspector-rank officers are also included in the SIT, which includes the officer of Civil Lines Police Station where the case was registered, the ANI report stated.

According to the report, the move comes a week after the party Rajya Sabha MP accused party chief Arvind Kejriwal's former personal secretary Bibhav Kumar of assaulting her at the Chief Minister's residence.
Reportedly, on Monday, the Delhi Police took the accused in Swati Maliwal assault case Bhibav Kumar to drawing room of Kejriwal's residence to recreate the events that transpired on May 13.
According to officials, the police took notes on the answers to all of their inquiries in order, plotted them, and photographed the scene of Swati Maliwal assault case.
Meanwhile, on Friday, Bibhav Kumar had filed a counter-complaint with the police, alleging Maliwal of 'unauthorised entry' into the CM's Civil Lines residence and 'verbally insulting' him.
