Court says no family would give a car and air-conditioner to a patriwala as dowry

Being a patriwala or a roadside vendor is no excuse to escape the compensation a wife can claim from a husband during divorce. More so if the groom was given a car and an air-conditioner as dowry.








Shahid's lawyer said the appellant was not even able to earn Rs 150 to 200 per day due to the increasing cost of vegetables. "The person who used to buy one kilogramme now prefers to buy only half-a-kilogramme of vegetable. Hence the appellant is not in position to pay such a big amount as maintenance, especially when he has divorced his wife," said the lawyer.

But the court went back a little and found out the man was paid a hefty dowry by the bride's family, which included a car and an air-conditioner. The court assumed no family would wed their daughter to a roadside vegetable vendor and that too with such a significant dowry.

Shahid's divorced wife Anjum, meanwhile, had informed the court that he is a wholesaler dealing in fruits and vegetables.

She stated that the marriage happened between the families of equal status and her husband was trying to evade the compensation by trying to portray himself as a petty vendor.

Additional Session Judge Pratibha Rani, while ordering Shahid to pay the monthly sum, said, "In case of an arranged marriage it can not be presumed that a well-off family, as that of complainant, which has the capacity to spend lakh in the wedding of their daughter would marry her off to a partriwala." She also mentioned that Rs 6,000 per month is not too high an amount considering that the couple also have a one-and-a-half year old daughter in the custody of her mother.
